Revision of Korean Trademark Law (Effective 1st September, 2005)

1. Legal Person may use a collective mark

• Legal Person, as well as his members, may use his collective mark.

2.  Definition of "Geographical Indication" is established and a collective mark that consists solely of a Geographical Indication can be registered.

• Geographical Indications means the indications that a good is originated from a region, where the quality, the reputation or any other characteristics of the good are attributable to the geographical origin.

• If the applicant of a collective mark is a legal person composed of persons who are producing or processing a good originating from a particular region, where the quality, the reputation of any other characteristics of the good are attributable to the geographical origins of the good, a collective mark that consists solely of a geographical indication MAY be registered
